{"id":763,"date":"2017-09-26T22:22:00","date_gmt":"2017-09-26T22:22:00","guid":{"rendered":"http:\/\/www.gamasutra.com\/view\/news\/306566"},"modified":"2017-09-26T22:22:00","modified_gmt":"2017-09-26T22:22:00","slug":"atlus-tries-fails-to-take-down-patreon-for-ps3-emulator-via-dmca","status":"publish","type":"post","link":"https:\/\/sickgaming.net\/blog\/2017\/09\/26\/atlus-tries-fails-to-take-down-patreon-for-ps3-emulator-via-dmca\/","title":{"rendered":"Atlus tries, fails to take down Patreon for PS3 emulator via DMCA"},"content":{"rendered":"<p>Sega-owned game company Atlus Co. <a href=\"http:\/\/atlus.com\/atlus-and-emulation\/\">confirmed today<\/a> that it attempted to get the Patreon for\u00a0the PlayStation 3 emulator <a href=\"https:\/\/rpcs3.net\/\">RPCS3<\/a>\u00a0taken down by invoking its rights to\u00a0<em>Persona 5\u00a0<\/em>under the\u00a0Digital Millennium Copyright Act.<\/p>\n<p>What&#8217;s especially interesting here is\u00a0how wide Atlus aimed with its DMCA takedown attempt, shooting not so much to stop people from talking about or emulating\u00a0<em>Persona 5\u00a0<\/em>on PC\u00a0but to stop anyone from financially supporting (via Patreon, at least) the RPCS3 emulation group at all.<\/p>\n<p>The company appears to have\u00a0been only partially successful; in a <a href=\"https:\/\/www.reddit.com\/r\/emulation\/comments\/72lo12\/statement_atlus_usa_attempts_to_shut_down\/\">statement<\/a> posted today on Reddit, a representative of the RPCS3 dev team claims that on Saturday Patreon (but not the dev team) received notice that Atlus had filed a DMCA takedown against the RPCS3 Patreon page.<\/p>\n<p>Notably, Patreon reportedly pushed back, stating that they believed the emulation group&#8217;s work fell under fair use and that the emulator itself did not infringe on any of Atlus&#8217; copyrights. Atlus reportedly retorted that the RPCS3 website gave specific instructions on how &#8220;circumvent our DRM protections&#8221;\u00a0by\u00a0dumping copies of PS3 games so they can be played on an emulator. As of now, the RPCS3 Patreon page is still up but all mention of\u00a0<em>Persona 5\u00a0<\/em>have been removed from both it and the RPCS3 website.<\/p>\n<p>&#8220;In discussion with the very helpful people over at Patreon we have decided to proceed with caution,&#8221; the respresentative added.\u00a0&#8220;Per the request of Patreon, we removed every single reference to <em>Persona 5<\/em> on the Patreon page itself and rpcs3.net. This seems to have resolved the situation.&#8221;<\/p>\n<p>Atlus has a track record of being touchy about the notion of people seeing\u00a0<em>Persona 5<\/em> without paying for it,\u00a0<a href=\"https:\/\/www.gamasutra.com\/view\/news\/295144\/Persona_5_dev_blocks_PS4_sharing_features_in_the_name_of_storytelling.php\">blocking it from being shared<\/a> via the PS4&#8217;s social features and <a href=\"https:\/\/www.gamasutra.com\/view\/news\/296920\/Amid_fan_outcry_Atlus_eases_up_on_Persona_5_sharing_limits.php\">setting limits<\/a> (backed up by threat of contentID strikes) earlier this year on how much of the game YouTubers and streamers may show.\u00a0<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Sega-owned game company Atlus Co. confirmed today that it attempted to get the Patreon for\u00a0the PlayStation 3 emulator RPCS3\u00a0taken down by invoking its rights to\u00a0Persona 5\u00a0under the\u00a0Digital Millennium Copyright Act.
