{"id":43754,"date":"2018-08-31T01:54:00","date_gmt":"2018-08-31T01:54:00","guid":{"rendered":"https:\/\/appleinsider.com\/articles\/18\/08\/30\/judge-dismisses-motion-to-halt-qualcomms-potential-iphone-import-ban"},"modified":"2018-08-31T01:54:00","modified_gmt":"2018-08-31T01:54:00","slug":"judge-dismisses-motion-to-halt-qualcomms-potential-iphone-import-ban","status":"publish","type":"post","link":"https:\/\/sickgaming.net\/blog\/2018\/08\/31\/judge-dismisses-motion-to-halt-qualcomms-potential-iphone-import-ban\/","title":{"rendered":"Judge dismisses motion to halt Qualcomm&#8217;s potential iPhone import ban"},"content":{"rendered":"<p><!-- font size selector, BEGIN --> <span class=\"cfix\">\u00a0<\/span> <\/p>\n<p class=\"gray small byline\"> By <a href=\"mailto:stephen@appleinsider.com\">Stephen Silver<\/a> <br \/><span class=\"gray\">Thursday, August 30, 2018, 06:54 pm PT (09:54 pm ET)<\/span> <\/p>\n<p> <span><span class=\"article-leader\">Plaintiffs in a class action lawsuit against Qualcomm had sought to stop the chipmaker from getting a theoretical import ban on Intel-equipped iPhones, but perennial Apple judge Lucy Koh has denied the motion.<br \/><\/span><\/p>\n<div align=\"center\">\n<div class=\"article-img\"><img decoding=\"async\" src=\"http:\/\/www.sickgaming.net\/blog\/wp-content\/uploads\/2018\/08\/judge-dismisses-motion-to-halt-qualcomms-potential-iphone-import-ban.jpg\" alt=\"Qualcomm\" height=\"383\" class=\"lazy\" \/><img decoding=\"async\" src=\"http:\/\/www.sickgaming.net\/blog\/wp-content\/uploads\/2018\/08\/judge-dismisses-motion-to-halt-qualcomms-potential-iphone-import-ban-1.jpg\" \/><\/div>\n<p><span class=\"minor2 small gray\"><\/span><\/div>\n<p>Judge Koh on Wednesday <a href=\"http:\/\/www.fosspatents.com\/2018\/06\/consumers-bring-motion-to-bar-qualcomm.html\">denied a motion<\/a> by plaintiffs in a class action suit to prevent <a href=\"https:\/\/appleinsider.com\/articles\/17\/07\/06\/qualcomm-asks-itc-to-block-import-and-sale-of-apple-iphone-ipad\">Qualcomm from obtaining a U.S. International Trade Commission exclusion order<\/a> that would affect the import of iPhones with Intel modems, reports <em>FOSS Patents<\/em>.<\/p>\n<p>&#8220;At bottom, Plaintiffs cannot sustain their request for a preliminary injunction because their asserted harm relies on a speculative and attenuated inferential chain, which centrally includes intervening decisions by multiple independent decisionmakers,&#8221; Judge Koh wrote. <\/p>\n<p>The motion was dismissed &#8220;without prejudice,&#8221; meaning that it can be brought again in the future. <\/p>\n<p>The plaintiffs, who are suing Qualcomm for antitrust violations, <a href=\"https:\/\/appleinsider.com\/articles\/18\/06\/28\/qualcomms-bid-to-block-iphone-imports-magnifies-antitrust-practices-consumers-contend\">filed the motion in June concerning Qualcomm&#8217;s separate proceeding<\/a> before the ITC, in which Qualcomm seeks to &#8220;prevent importation of certain Apple devices into the United States.&#8221; The issue Koh ruled on this week was the plaintiffs&#8217; motion for a preliminary injunction, which sought to &#8220;enjoin Qualcomm from enforcing any exclusion or cease-and-desist order that the ITC may issue in that action.&#8221; <\/p>\n<p>The motion was brought by plaintiffs who believe that Qualcomm&#8217;s ITC complaint represents an anti-competitive action. <\/p>\n<p>Judge Koh, for jurisdictional reasons, often presides over cases related to Apple and other Silicon Valley-based companies, <a href=\"https:\/\/appleinsider.com\/articles\/18\/05\/14\/apple-versus-samsung-548m-smartphone-patent-battle-returns-to-court\">including the recent trial between Apple and Samsung.<\/a> <\/p>\n<p><\/span> <\/p>\n","protected":false},"excerpt":{"rendered":"<p>\u00a0 By Stephen Silver Thursday, August 30, 2018, 06:54 pm PT (09:54 pm ET) Plaintiffs in a class action lawsuit against Qualcomm had sought to stop the chipmaker from getting a theoretical import ban on Intel-equipped iPhones, but perennial Apple judge Lucy Koh has denied the motion.
