{"id":20119,"date":"2018-05-11T19:46:00","date_gmt":"2018-05-11T19:46:00","guid":{"rendered":"http:\/\/www.gamasutra.com\/view\/news\/318009"},"modified":"2018-05-11T19:46:00","modified_gmt":"2018-05-11T19:46:00","slug":"twitch-files-counter-complaint-against-banned-csgo-streamer","status":"publish","type":"post","link":"https:\/\/sickgaming.net\/blog\/2018\/05\/11\/twitch-files-counter-complaint-against-banned-csgo-streamer\/","title":{"rendered":"Twitch files counter-complaint against banned CS:GO streamer"},"content":{"rendered":"<p>Twitch has filed a counter-complaint\u00a0against\u00a0the lawsuit filed by former &lt;i&gt;Counter-Strike: Global Offensive\u00a0streamer&lt;\/i&gt; James &#8216;Phantoml0rd&#8217; Varga, who <a href=\"https:\/\/www.gamasutra.com\/view\/news\/314807\/After_600_days_of_being_banned_former_CSGO_streamer_sues_Twitch.php\">sued the company nearly three months ago<\/a>\u00a0for damages after being banned indefinitely from the platform\u00a0back in July 2016.\u00a0<\/p>\n<p>Varga\u00a0was banned\u00a0and his channel was removed after he allegedly failed to\u00a0disclose\u00a0his business ties to a\u00a0<em>Counter-Strike<\/em>: Global Offensive gambling site (where players could gamble with weapon skins since they had monetary value), which he promoted during his streams.\u00a0<\/p>\n<p>In a lesser offense, Varga\u00a0was warned by Twitch for violating its policy against &#8220;sexually suggestive content, content involving self-harm, and content involving racist symbols.&#8221;<\/p>\n<p>As reported <a href=\"https:\/\/www.polygon.com\/2018\/5\/10\/17338876\/cs-go-twitch-phantomlord-lawsuit\">by Polygon,<\/a> Twitch&#8217;s\u00a0counter-complaint (which was filed on May 2)\u00a0says it\u00a0handled Varga\u2019s ban properly demanding \u201can award of compensatory damages\u201d for harm Varga brought upon the company and Twitch users. Twitch also stated\u00a0that any supposed damages alluded to in Varga\u2019s lawsuit are \u201cvague, uncertain, imaginary, and speculative.\u201d\u00a0<\/p>\n<p>The counter-complaint also argues that Varga was warned and received penalties a year in advance \u201cfor streaming content that violated his contract with Twitch, Twitch\u2019s Terms of Service and its Rules of Conduct.\u201d<\/p>\n<p id=\"1TuMMI\">Although the rebuttal doesn&#8217;t go into\u00a0how much the company is looking for in redresses, Twitch\u00a0is asking for compensatory damages and full coverage of legal fees throughout the duration of the case.
