{"id":19268,"date":"2018-05-03T15:05:00","date_gmt":"2018-05-03T15:05:00","guid":{"rendered":"http:\/\/www.nintendolife.com\/news\/2018\/05\/federal_government_is_officially_investigating_nintendo_for_possible_patent_infringement"},"modified":"2018-05-03T15:05:00","modified_gmt":"2018-05-03T15:05:00","slug":"federal-government-is-officially-investigating-nintendo-for-possible-patent-infringement","status":"publish","type":"post","link":"https:\/\/sickgaming.net\/blog\/2018\/05\/03\/federal-government-is-officially-investigating-nintendo-for-possible-patent-infringement\/","title":{"rendered":"Federal Government Is Officially Investigating Nintendo For Possible Patent Infringement"},"content":{"rendered":"<div class=\"media_block\"><a href=\"http:\/\/images.nintendolife.com\/news\/2018\/05\/federal_government_is_officially_investigating_nintendo_for_possible_patent_infringement\/large.jpg\"><img decoding=\"async\" src=\"http:\/\/images.nintendolife.com\/news\/2018\/05\/federal_government_is_officially_investigating_nintendo_for_possible_patent_infringement\/small.jpg\" class=\"media_thumbnail\"><\/a><\/div>\n<aside class=\"picture embed centered picture-900x img-900x\">\n<div class=\"img\"><a title=\"Screen Shot 2018-05-03 at 15.56.59.png\" href=\"http:\/\/images.nintendolife.com\/news\/2018\/05\/federal_government_is_officially_investigating_nintendo_for_possible_patent_infringement\/attachment\/0\/large.jpg\"><img decoding=\"async\" src=\"http:\/\/images.nintendolife.com\/news\/2018\/05\/federal_government_is_officially_investigating_nintendo_for_possible_patent_infringement\/attachment\/0\/900x.jpg\" alt=\"Screen Shot 2018-05-03 at 15.56.59.png\"\/><\/a><\/div>\n<\/aside>\n<p>Following accusations from accessories company <a href=\"http:\/\/www.nintendolife.com\/news\/2018\/05\/gamevice_wants_the_us_to_block_nintendo_switch_imports_because_it_infringes_on_its_patents\">Gamevice<\/a> that Nintendo violated its patent on a \u201cCombination Computing Device and Game Controller with Flexible Bridge Section\u201d, the US Trade Commission has now officially launched an investigation into the complaint.<\/p>\n<p>While Gamevice\u2019s initial lawsuit filing last August didn\u2019t appear to have much substance, it\u2019s clear that things are more serious now \u2013 for both Nintendo of America, and Nintendo Co. in Japan.<\/p>\n<p>Actions against the company have yet to be taken \u2013 the USITC is currently determining Nintendo\u2019s guilt regarding patent infringement, stating in an <a class=\"external\" href=\"https:\/\/www.usitc.gov\/press_room\/news_release\/2018\/er0501ll939.htm\">announcement<\/a> yesterday:<\/p>\n<blockquote readability=\"9\">\n<p><em>The products at issue in the investigation are controller systems with parts that attach to two sides of an electronic device, such as a smartphone or tablet, and the parts fit into a user\u2019s hands and have gaming controls.<\/em><\/p>\n<\/blockquote>\n<p>It could take months for the administrative law judge tasked with the investigation to come to a conclusion. The commission will first hold an evidentiary hearing to determine the legitimacy of Gamevice\u2019s complaint, with a decision on the complaint\u2019s validity to be made \u201cat the earliest practicable time\u201d.<\/p>\n<p>In the meantime, there is nothing stopping Nintendo from continuing to sell Switches. Additionally, based on the tremendous success of the Switch, it\u2019s unlikely that Gamevice would pursue anything beyond court-ordered royalty payments \u2013 considering it\u2019s driving quite a steady stream of revenue at the moment.<\/p>\n<p><em>Do you think Nintendo intentionally used Gamevice\u2019s ideas and violated its patent \u2013 or is this simply par for the course with large companies like Nintendo?
